By accessing, using, submitting data to, or otherwise interacting with the Service or providing information to us, you agree to the practices described in this Privacy Policy. We may collect data about users of the Service directly from you (such as when you register for an account or take a quiz), automatically when you use the Service (such as when you interact with a webpage), and sometimes from third parties (such as our service providers, business partners, and other third parties). Some of this data may be considered “personal information” or “personal data”, and some of which may be considered “sensitive”, under various applicable laws. We will also treat other information, including IP addresses and cookie identifiers, as “personal data” where required by applicable law and we will treat certain personal data as “sensitive data” as required by applicable law.
Note that we may de-identify or pseudonymize personal data so that it is non-personal, such as aggregating (such as combining it with data about other individuals) and/or or converting it to a code, sometimes using a function commonly known as “hash”, or otherwise removing characteristics that make the data personally identifiable to you. We will treat de-identified or pseudonymized data as non-personal to the fullest extent allowed by applicable law. If we combine non-personal data with personal data, then we will treat the combined information as personal data under this Privacy Policy.

Payment Data. When you make a purchase, we collect payment data, such as credit card, billing, and other financial information, and information about your transaction history. You also have the option to store payment information for future purchases. We may use third party payment processors.
User Content and Submission Features. The Service may permit you to submit or post photos, audio, video, text, files, social media posts, or other content (“User Content”) through interactive or other features, such as reviews, surveys, product Q&As, blog comments, gallery posts, or promotional activities (“Submission Features”). Your submission of User Content is subject to the Terms of Service https://thisisneeded.com/policies/terms-of-service for the Service which gives us the right to use your User Content, online or offline, in connection with our promotional activities. Personal information, such as your name, user name (from the Service or your social media account), or where you reside, may be publicly displayed with your User Content. Others may access it, use it, and share it. We are not responsible for how others use User Content you submit or post. In addition, in connection with certain activities, your personal information may be disclosed publicly, for example, being identified as a winner of a sweepstakes or being awarded a prize.
Chat Support. When you participate in a customer service or similar chat feature with us, Needed may record, use, and retain your communications and the data you provide in order to assist you during the chat session, provide customer support, to improve our products and services, included to train Needed’s AI customer service agents to better help our customers, and for marketing purposes. If you do not consent, please do not continue with chat assistance.
Cookies, Tags, and Other Technologies. When you use the Service, Needed and our third-party business partners (including any third-party service providers or third-party content, advertising, and analytics partners) may use a variety of technologies, including cookies and pixel tags, that automatically or passively collect certain information when you access, use, or otherwise interact with the Service (“Device ID/Interaction Information”).

Cookies and Local Storage. A “cookie” and local storage are text files placed within a browser on a device when it is used to visit the Service. Pixel Tags. Small graphic images or other web programming code (also known as a web beacon, Internet tag, pixel tag, or clear GIF) may be included in our web pages and email messages. These and similar technologies may be used for a number of purposes by us and our third-party providers, including to transmit information about actions of the user opening the page or email containing the beacon back to a web server, to count visitors to the Service, to monitor how users navigate Service, to count how many particular products were viewed, or for marketing and targeted advertising purposes. The data we collect through this technology may include the first date and time you open our email, and whether you click any links included in our email.
Embedded Scripts. An embedded script is programming code that is designed to collect data about your interactions with the Service, such as the links you click on. The code is temporarily used by our server or a third-party service provider or business partner while you browse or interact with the Service and is deactivated or deleted when you disconnect from the Service.
Session Replay Technology. Needed may record through session replay technology your interactions with the Service, such as what pages you visit on the Service, how long you visit those pages, and any links you click or data you provide. We use this data for our internal business purposes, such as for website analytics, to improve the Service and our products and services, and to address functionality issues.
Approximate Location Data. Please note that we may be able to collect or infer your approximate location through other data we collect, such as IP address. In addition, some mobile service providers may also provide us or our third-party providers with data regarding the physical location of the device used to access the Service.
Enhancement Data. We may receive data about you from other third parties, such as data aggregators, joint marketing partners, third party websites, service providers and other business partners. We may also supplement the data we collect with outside records from third parties, such as public databases, publicly available social media pages, and third parties who enhance the data we have about you, in order to provide you with information or services you have requested, to tailor content, to offer you opportunities to purchase products or services that we believe may be of interest to you, and for other purposes. The data collected and stored by third parties is subject solely to the third party’s privacy practices.

Third Parties Providing Services on Our Behalf. We may share personal data about you with contractors, service providers, and other third parties who provide services on our behalf, such as fulfilling orders, providing processing or other information technology services, marketing our services to you on our behalf, carrying out research and analysis, and personalizing your guest experience, site and app development, website hosting, data analytics, product shipping, sending email or other communications, security and fraud prevention vendors, and similar entities. We do not allow these third parties to use or share this information for any purpose other than to provide services on our behalf. Certain service providers may use AI/machine learning models to provide services to us on our behalf.
Third Party Integrations/Other Third Parties to Whom You Agree or Direct Us To Share Your Information. We do not share your personal data with third parties for those third parties’ direct marketing purposes without providing you the ability to consent (opt-in or opt-out). We may share information when you direct us to do so, including when you log in through a third-party application or feature through which information is shared, or if we present you with an opportunity to receive marketing offers from a third party.
Please note that we are not responsible for the privacy practices of any third party. If you decide that you do not want to receive communications from a third party, or have questions about their privacy practices, you will need to contact that third party directly.
If you choose to post information to a third-party platform, that information may be public.
Third Party Advertising and Analytics Partners. As fully described in the section below titled “Third Party Advertising and Analytics Third Parties and Similar Third Parties”, we share (or allow third parties to collect) certain data, including about how you use the Service, to target advertising to you and others and assess the effectiveness of our advertising, and for similar purposes.
Other Users of our Services. If you choose to leave a product review or participate in a product Q&A or other feature, we may make certain information about you available to other users of our Service. In such cases, we will share certain information you provide, including your first name, last initial, current life stage (if you choose to share it), dietary restrictions (if you choose to share it), and state with our users.
Sweepstakes, Contests, Promotions. We may offer sweepstakes, contests, or other promotions (any, a "Promotion"), that may require registration. By participating in a Promotion, you are agreeing to the provisions, conditions, or official rules that govern the Promotion, which may require specific requirements of you (including, without limitation, and except where prohibited by law, allowing the sponsor(s) of the Promotion to use your name, voice, likeness, or other indicia of persona in advertising or marketing materials). If you choose to enter a Promotion, personal data may be disclosed to third parties or the public in connection with the administration of such Promotion, including, without limitation, in connection with winner selection, prize fulfillment, as required by law or permitted by the Promotion’s terms or official rules (such as on a winners list).
Employment Applications. If you apply for a job with us, we or our applicant portal provider(s) may ask you to provide self-identifying information (such as veteran status, gender, and ethnicity) in conjunction with laws and regulations enforced by the Equal Employment Opportunity Commission and other federal, state, and local regulatory agencies. Providing such self-identifying information is voluntary, but if you do provide such information, we and/or our providers may submit that information to the appropriate government or regulatory agencies to fulfill reporting requirements and use that information to defend against employment-related complaints. Please note that we may utilize a careers portal that is operated by a third party, in which case, your registration and use of the careers portal will be subject to the third party’s privacy practices as disclosed on the portal.
Non-Personal Data. Except as expressly prohibited by law, we may share non-personal data that we collect, such as certain Device ID/Interaction Information, aggregate user statistics, and hashed or otherwise de-identified or pseudonymized data (including email addresses), and/or our analyses derived from such data, with third parties in our discretion, including for targeted advertising purposes.
SMS/MMS/RCS Message Data. Notwithstanding anything else in this policy, Needed does not share personal information we collect specific to our SMS/MMS/RCS text message programs (such as mobile number and record of consent) with third parties for their own direct marketing purposes without your specific consent.
For Legal and Administrative Purposes. Needed reserves the right to disclose any data as needed to comply with any court order, law, or legal process, including to respond to any government or regulatory request; to protect the integrity of the Site; to fulfill your requests; to cooperate in any law enforcement investigation, an investigation on a public safety matter, or an investigation into claims of intellectual-property infringement; to protect and defend the legal rights or property of Needed and its affiliates and shareholders, any Service or its users, or any other party; or, in an emergency, to protect the health and safety of our users or the general public. We may also use Device Identifiers to identify users, and may do so in cooperation with copyright owners, Internet service providers, wireless service providers, or law enforcement agencies, in our discretion.
Law Enforcement. We may disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose us to legal liability. This may involve sharing various information relating to our users and fraudulent or potentially fraudulent activities with our fraud prevention, credit risk reduction, and similar service providers, and they will use this information to help us and their other clients prevent fraudulent and illegal transactions.
Business Transfers/Changes of Control. In the event Needed goes through a business transition, Needed reserves the right to disclose and transfer all personal information related to the Service (including, without limitation, during the course of any due diligence process): (i) to a subsequent owner, co-owner, or other transferee or operator of the Service; or (ii) in connection with a corporate merger, divestiture, restructuring, reorganization, dissolution, sale, other transfer of some or all of our assets, or other company change. By providing your data, you understand and agree that we may transfer such data to the acquiring entity without your further consent, except where required by law.
We may also use third-party business partners, such as companies offering analytics tools (such as Google Analytics), ad agencies, network advertisers, and others who provide us with information about use of the Service, users, our advertisements, and user traffic, and who deliver ads to you on our behalf on the Service and elsewhere online. Our third party business partners collect certain data about your visits to and activity on the Service and other websites and services, and may use this data to target advertising to you and others and to assess the effectiveness of our advertising. We may also disclose (or permit third parties to collect) data, such as Device ID/Interaction Information, aggregate or de-identified, pseudonymized or hashed information (including email addresses) with these third parties for similar purposes.
These third parties may set and access their own tracking technologies on your device (including cookies, pixel tags or other technology) and may otherwise collect or have access to your personal data over time, including about your visits to the Service as well as other websites and online services, some of which may be personal information or personal data under various state laws. Companies that we share data with, including ad agencies and networks, may use the data, often in combination with their existing data, in order to present more relevant advertisements that may be of interest to you, and to help us and third parties to do the same.
Cookie Opt-Out Tools. To disable sharing through cookies set on our site by third parties for advertising and analytics purposes, please adjust your settings by clicking on ‘Cookie Preferences’ in the footer.
NAI/DAA Opt-Out. Some of the companies we use may be members of the Network Advertising Initiative (“NAI”) or Digital Advertising Alliance (“DAA”). The NAI provides information regarding targeted advertising and the opt-out procedures of NAI members, including opt-out mechanisms for web browsers and mobile devices, and a tool to opt out from participating NAI members using your hashed email address for interest-based advertising. Google Analytics. We use Google Analytics, which uses cookies and similar technologies to collect and analyze data to help us understand how the Service is used and report on activities and trends. This service may also collect data about the use of other websites, apps, and online services. You can learn about Google's practices, and opt out of them by downloading the Google Analytics opt-out browser add-on.
Please note that opting out through these mechanisms does not opt you out of being served advertising, and that you will continue to receive generic ads while online. Your opt-out choices are browser and device specific; if you disable your cookies, upgrade your browser after opting out or if you use multiple different devices, please opt-out on each device and each browser separately.
The Service may permit or facilitate interactions with an interactive third-party website or service ("Social Media"), such as enabling you to "like" or "share" content. If you choose to share content or otherwise post information from or via the Service to Social Media, that data may be public, and the third party may have access to data about you and your use of the Service. You may also choose to participate on Social Media in a way that connects that third-party service with the Service (such as posting to one of our pages on a Social Media site). Doing so may allow us to collect (or the third party to share) data about you. These third-party Social Media platforms may be able to collect certain data about your visits to the Service regardless of whether or not you affirmatively interact with the feature and whether or not you are logged into (or have) an account with the third-party platform.
We may also receive data about you if other users of Social Media give us access to their profiles and you are one of their connections or "friends". The data we collect is subject to this Privacy Policy. The data collected and stored by the third party remains subject to the third party’s privacy practices, including, without limitation, whether the third party continues to share data with us, the types of data shared, and your choices with regard to what is visible to others on that third-party website or service. The third party may allow you to remove the application or feature, in which case we will no longer collect data about you through the application or feature, but may retain the data previously collected.
Needed is not responsible for the privacy policies of third parties or other sites, even if they are linked to our Service. Needed includes these links solely as a convenience to you, and the presence of such a link does not imply a responsibility for the linked site or an endorsement of the linked site, its operator, or its contents. Please make sure you read their privacy policy before using those sites when you leave our Service.
We have implemented commercially reasonable measures intended to protect your personal information. Please note that the electronic transmission over the Internet, wireless transmission, or electronic storage of information is not completely secure. We cannot warrant or guarantee the security of any information we collect. You use the Service and provide us your personal information at your own risk.

If you have received a promotional email from us, you can opt out of receiving future promotional emails from us by following the unsubscribe instructions contained in such email or by adjusting your user preferences in your account profile. You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information. You can review and change the personal information associated with your account by logging into your account and visiting your account profile page. Needed will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable. Note, however, that data may persist internally for administrative purposes and that residual data may remain on backup media or for other reasons. The Service are not directed to, and Needed does not knowingly collect or solicit personal information from, children under the age of 18. To the extent permitted by applicable law, Needed reserves the right to update or change this Privacy Policy at our discretion at any time. The personal information that you provided us is not governed by the HIPAA privacy or security rules, as Needed is not a covered entity under HIPAA.

To submit a verifiable request, you will be asked to provide certain information to help us verify your identity. The information we ask you to provide to initiate a request may differ depending upon the type of request, the type, sensitivity and value of the personal information that is the subject of the request, and the risk of harm to you that may occur as a result of unauthorized access or deletion, among other factors. We may also require you to provide a written declaration that you are who you say you are.
Please note that as part of the verification process, once you submit a request to delete, we may follow up and require you to confirm that you want your information deleted.
You may designate an authorized agent to make a request on your behalf by providing the agent with signed written permission to do so. The written permission must state your full legal name, the full legal name of the individual who is the subject of the request, and needs to be clear about the permission granted. Alternatively, you may submit a copy of a power of attorney under Probate Code sections 4000-4465. In either case, please also indicate in your email the nature of your request. The consumer's identity, in addition to the agent’s, will need to be independently verified in order for us to be able to fulfill your request. We may also ask the consumer to directly confirm with us that they provided you permission to submit a request. Please keep in mind that if we do not receive adequate proof that you are authorized to act on the consumer's behalf, we may deny the request.
Needed does not sell Personal Information to third parties for monetary consideration. However, the collection of data on our behalf by certain of our third-party site analytics or digital advertising service providers may be considered a “sale” and is considered “sharing” under the CPRA. To opt-out of the sale of Personal Information or sharing for cross-context behavioral purposes by Needed, please follow the instructions above.

Needed does not have actual knowledge that we sell or share Personal Information about individuals younger than the age of 18.
As disclosed in the chart below, we may collect certain information which is considered Sensitive Personal Information under California law. This includes: driver’s license numbers for verification purposes; data collected and analyzed concerning a consumer’s health; or data collected and analyzed concerning a consumer’s sex life or sexual orientation. In the preceding twelve (12) months, Needed has collected, used, disclosed, sold, and shared the categories of Personal Information in the “Personal, Sensitive, and Non-Personal Information We Collect” section above. Needed also collects and discloses the Personal Data set forth below for a variety of business purposes as described in the “How We Use the Information We Collect” section above.
We retain your personal information for as long as reasonably necessary to carry out the purposes for which it was collected, allow you to exercise the choices and rights you requested, to comply with applicable law, comply with our contractual obligations, resolve disputes with third parties, and to enforce our agreements.
Under California regulations, certain programs we offer that provide benefits to consumers may be considered financial incentive programs. We may collect personal information from you in connection with these programs, e.g., such as contact information (name, email address, phone number) and certain commercial information (e.g., transaction history) for a number of reasons, including to administer the program, contact you with regard to your account (if any), to provide the benefits to you, to better serve you, and to fulfill your requests associated with the program.

To the extent that we provide a program that may be considered a financial incentive because the program is directly or reasonably related the collection, deletion or sale or retention of consumer personal information, the value is reasonably related to the overall value we receive from the personal information participants provide specific to the program minus the costs and expenses we incur in providing the program.
Do Not Track is a privacy preference that you can set in your web browser to choose your preference as to whether you want to allow the collection of information about your online activities over time and across different websites or online services.
